Legal Costs Agreement
Terms and Conditions of Engagement

Queensland Legal Pty Ltd (ABN 38 619 112 917) (“Queensland Legal”) is offering to provide the client named herein with legal advice and associated legal services.

The exact scope for those services is, as yet, unknown.

I/We (“Client”) accept the offer and engage Queensland Legal on these initial terms.

For the legal services provided, Queensland Legal will charge the Client on the basis of the time spent working on their matter, and providing their services.

Time will be charged in 6-minute intervals with six minutes being the minimum interval recorded for legal services. For example, the time charged for an attendance of up to six minutes will be one unit and the time charged for an attendance between six and twelve minutes will be two units.

The hourly rate for services by a Lawyer/Director for providing the legal services will be $440.00 per hour (Inc GST).

Queensland Legal will render a tax invoice to the Client for the legal services from time to time. All tax invoices are payable within 7 days of delivery of the invoice and interest may accrue on overdue amounts at the rate prescribed by the Legal Profession Act 2007 (Qld).
Queensland Legal may request a deposit of 'trust money' into the Queensland Legal Law Practice Trust Account as security for anticipated legal fees, expenses and disbursements.

If the Client does not pay a tax invoice or deposit 'trust money' when requested, then Queensland Legal may cease providing legal services to the Client immediately.

The Client authorises Queensland Legal under regulation 58(3)(a)(i) of the Legal Profession Regulations 2007 to withdraw any money held for the Client in its trust account to pay their tax invoices (including GST).

The Client authorises Queensland Legal (pursuant to section 8 of the Trust Accounts Act 1973 (Qld)) to use money that they are holding for the Client in its trust account to pay the Client's legal fees, costs and/or GST payable to Queensland Legal.

The Client may terminate this Agreement and withdraw their instructions at any time for any reason by giving written notice to Queensland Legal.

Queensland Legal may terminate this Agreement for any just cause by providing reasonable notice to the Client, in writing.

If this Agreement is terminated, Queensland Legal are entitled to the payment of legal fees, expenses and disbursements (including GST) up to and until the date the termination notice is provided.

Queensland Legal may retain possession of the Client’s file until the Client has paid all money owing to them by the Client.

Unless already returned to you, Queensland Legal will keep your Client documents, relating to the legal work performed for you, for seven (7) years after this Agreement has ended or has been terminated. After this time, we may destroy them without contacting you again. You may request a copy of your Client documents at any time, which may be kept by us solely in electronic form.

The Client authorises Queensland Legal to communicate with them by email. This may include (but is not limited to); sensitive, confidential, or personal information regarding the matter; documents relevant to the matter as attachments; and our legal bills/invoices.

The Client consents to, and accepts, service of Queensland Legal’s tax invoices to be effected upon them electronically, regardless if the legal bill is also sent by post, pursuant to section 330(7) of the Legal Profession Act 2007 (Qld).

An accurate estimation of the Client’s legal costs cannot be provided at this time.
However, the Client’s professional legal fees (pursuant to this initial Agreement) will not exceed $1,500 (Exc GST). Important Note: This amount relates to professional fees and does not include any applicable disbursements or expenses we incur, as your agent which may be incidental to providing the legal services to you.

If we consider that your professional fees may exceed $1,500 (Exc GST) then Queensland Legal will provide the Client with any further costs disclosure required, pursuant to the Legal Profession Act 2007 (Qld), and issue an updated Legal Costs Agreement with the Client.
